Terms of Service

1. Acceptance of Terms
By creating an account, installing the software, or accessing The Good Parent ("TGP") services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
2. Description of Service
TGP provides a software-as-a-service platform designed to assist parents and legal guardians in monitoring and managing their children's device usage. Features include screen time tracking, app usage monitoring, web history logging, location tracking, and screenshot capture.
3. Eligibility and User Responsibilities
Eligibility
You must be at least 18 years old to create an account and subscribe to the Service.
Authorized Use
You explicitly represent and warrant that:
- You are the legal parent or court-appointed guardian of any child whose device you monitor using the Service
- You are monitoring a device that is owned by you or the child for whom you are the legal guardian
- You will use the Service solely for the purpose of parental control and safety monitoring
- You will comply with all applicable laws regarding monitoring and privacy
4. Prohibited Use & Legal Compliance
Strictly Prohibited: You may not use the Service to monitor:
- A spouse, partner, or significant other
- Employees or colleagues
- Any person for whom you are not the legal guardian
- Any person over the age of 18 (unless you are the legal guardian of an adult dependent)
Zero Tolerance Policy: Any attempts to use our system for illegal activities, spying, unauthorized access attempts, or other malicious behavior will be reported to law enforcement authorities. We will cooperate fully with law enforcement to identify and prosecute offenders to the fullest extent of the law.
Violation of this section may result in immediate termination of your account and potential legal liability.
5. Account Security
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. TGP is not liable for any loss or damage arising from your failure to protect your password.
6. Privacy and Data Protection
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and share your data and the data of your child. By using the Service, you consent to the data practices described in the Privacy Policy.
Our Security Commitment
We take data security seriously:
- All data is encrypted at rest and in transit
- Data is processed through AI systems—no human reviews your personal data unless you specifically authorize support access
- Data is retained only for the period defined by your subscription plan tier
- We conduct regular security audits of our systems
7. Subscription and Payment
- Fees: Access to premium features requires a subscription. Fees are billed in advance on a recurring basis (monthly or annually)
- Cancellation: You may cancel your subscription at any time via your account dashboard. You will continue to have access until the end of your current billing period
- Refunds: Refunds are handled on a case-by-case basis or as required by applicable consumer protection laws
8. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of The Good Parent and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- "AS IS" Basis: The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the Service will be uninterrupted, secure, or error-free
- AI Limitations: Our AI systems can make mistakes—no monitoring system is perfect. Parents should maintain open communication with their children as the primary means of protection
- No Guarantee of Safety: While TGP provides tools to help manage digital safety, we cannot guarantee that your child will be safe from all online harms. You remain primarily responsible for your child's safety and upbringing
- Liability Cap: In no event shall TGP be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount you paid to us in the 12 months prior to the event giving rise to the claim
10. Indemnification
You agree to defend, indemnify, and hold harmless TGP from and against any claims, damages, obligations, losses, liabilities, costs, and expenses arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party right, including privacy rights (e.g., monitoring someone you do not have the legal right to monitor)
11. Termination
We reserve the right to terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.
12. Governing Law
These Terms shall be governed and construed in accordance with the laws of the United States and the State of New Jersey, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved in the state or federal courts located in New Jersey.
Violations will be prosecuted under the laws of the State of New Jersey, USA, as well as applicable federal laws.
13. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
